All repairs or replacements covered by this warranty must be authorized in advance by ENGINEQUEST. We assume no liability unless we are contacted before any work is done and agree in writing that it is authorized to be performed. The warranty period is not extended if ENGINEQUEST repairs or replaces the product.
LIMITATIONS: This warranty only applies to products originally supplied directly by ENGINEQUEST. This warranty is not transferrable and does not apply to or include any of the following: (1) damage as a result of an act of God, misuse, abuse, accident, over-heating, lack of lubrication, contamination, or improper use, installation, operation or maintenance; (2) repair or replacement of any accessory or service item, including but not limited to: (a) all components of the cooling, fuel, electrical and ignition systems; and (b) all belts, hoses, and filters; (3) any product used for competition, racing, performance, hot rod or similar or related purposes; (4) any product to which a device or accessory not conforming to original manufacturer's specifications has been installed or removed; (5) any product on which periodic maintenance services required by the OEM have not been performed; and (6) any product that has been modified or disassembled without the prior written authorization from ENGINEQUEST. To be valid, crankshaft warranty requires installation of new harmonic balancer at time of crankshaft installation.
LIMITED LIABILITY: ENGINEQUEST SHALL NOT BE LIABLE FOR SPECIAL, INDIRECT, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS OR PRODUCTION OR COMMERCIAL LOSS IN ANY WAY (including, without limitation, for rental cars or towing fees), REGARDLESS OF WHETHER SUCH CLAIM IS BASED IN CONTRACT, WARRANTY, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER THEORY OF LIABILITY, EVEN IF ENGINEQUEST HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LAW: These terms are governed by Nevada law without giving effect to any choice or conflict of law provision or rule (whether of the State of Nevada or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of Nevada.. There are no third-party beneficiaries. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
No dealer nor any agent or employee thereof, is authorized to extend or modify this warranty.
